Private Auto, Inc, a Utah corporation (“PrivateAuto” or “We”) does not sell your data! We strive to conform to the California Consumer Privacy Act of 2018 (CCPA), and want you to know that you have rights under the CCPA. Any cookies used on this site are for functionality and are not shared with outside entities other than the services we use to specifically help you transmit money for auto sales. We respect your privacy and are committed to protecting it through our compliance with this policy. This policy describes the types of information we may collect from you or that you may provide when you visit the website www.privateauto.com or use our mobile applications (collectively, our "Website") and our practices for collecting, using, maintaining, protecting, and disclosing that information.

Information We Collect About You and How We Collect It

We collect several types of information from and about users of our Website, including information:

  • Personally Identifiable Information (as defined below) that you provide to us on the Website regrading you or your vehicle;
  • That is about you but individually does not identify you, such as your vehicle information; and/or
  • About your internet connection, the equipment you use to access our Website, and usage details.

We collect this information:

  • Directly from you when you provide it to us (when you type it into our forms online)
  • Automatically as you navigate through the Website. Information collected automatically may include usage details, IP addresses, and information collected through cookies. Again, this info is taken only so the site can perform better for you, and we don’t sell or share this info with others.

Personally Identifiable Information

“Personally Identifiable Information” is any information that may be used to identify an individual, including, but not limited to, a first and last name, home or other physical address, an email address, phone number or other contact information. Private Auto collects Personally Identifiable Information from you only when you choose to make it available to us on the Website, and may include, without limitation, the city where you live, your zip code, your first and last name, your billing address, vehicle registration/titling information, your cell phone number, your email address, information regarding your vehicle and its history, and any personally identifiable information you provide in your communications to prospective buyers or sellers, made through the Website. By providing us with your mobile phone number, you agree that we may send information to your mobile phone via text message or email.

Information You Provide to Us

The information we collect on or through our Website may include:

  • Information that you provide by filling in forms on our Website. This includes information provided at the time of registering to use our Website, posting material, or requesting further services.We may also ask you for information when you report a problem with our Website.

Third Party Services

We utilize Plaid Inc. (“Plaid”) to gather your data from your financial institutions to perform the services you request on the Website. By using the Website, including its services, you grant Private Auto and Plaid the right, power, and authority to act on your behalf to access and transmit your personal and financial information from your relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by Plaid in accordance with the Plaid end user privacy policy. Additionally, if you choose to open an account with USAlliance Federal Credit Union, you understand that such account is issued by USAlliance Federal Credit Union and you conform acceptance of USAlliance Federal Credit Union’s privacy policy.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

  • To present our Website and its contents to you.
  • To provide you with information, products, or services that you request from us.
  • To fulfill any other purpose for which you provide it.
  • To provide you with notices about your account, including expiration and renewal notices.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.

We do not control third parties' collection or use of your information to serve interest-based advertising; however, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website. Accessing and Correcting Your Information

You can review and change your personal information by logging into the Website and visiting your account profile page.

You may also send us an email at support@privateauto.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

California Privacy Rights for all Users

We include the rights granted under the CCPA in these Terms and apply those rights to all users. The Personal Information collected by the Website does not include information that is publicly available information for government records, deidentified or aggregated consumer information, and health or medical information. You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions (the “right to delete”). Once we receive your request and confirm your identity, we will revie your require to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We will delete or deidentify personal information not subject to one of these exceptions from our records and will direct our service providers to take similar action. To exercise your rights to know or delete, submit a request by emailing us at support@privateauto.com.

Only you, or someone legally authorized to act on your behalf, may request to know or delete related to your personal information. You may also make a request to know or delete on behalf of your child. You may only submit a request to know twice within a 12-month period.

Your request to know or delete must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative. You request to know or delete must also provide a detailed description that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact support@privateauto.com.

We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

It is our policy to post any changes we make to our privacy policy on this page with a notice that the privacy policy has been updated on the Website home page.
